ANL Avocat attaches great importance to respecting your data.
You will find on this page the rules applicable to the processing of the personal data of the Law Firm.

ANL Avocat collects and processes the following personal data:

Your data relating to the legal files handled by ANL Avocat at your request: legal questions, court files including any convictions or sanctions concerning you, the information contained in the documents that you entrust to ANL Avocat as part of its advisory mission or to ensure your defense, including, data relating to your physical or mental state of health, etc.
Sensitive data (e.g. health data) or criminal convictions and offenses are subject to enhanced protection. They are processed with a view to delivering the Firm's services according to the terms of your consent.

Your data relating to training, career and skills: for example Data relating to a candidate, in the context of a recruitment procedure. Data relating to your carreer and skills (e.g. in case of internal investigation or legal proceedings)

Data relating to your centers of interest and consumption habits: for example, depending on the training courses or webinars to which you register, your subscriptions to ANL Avocat newsletters, your telephone calls or visits to the Firm, etc.

Your technical data: visits to the anl-avocat.com website, IP address, browser, type of device used, operating system, time zone settings, etc.
Sometimes, the collection and use of this Data is necessary for the execution of the service contract or the legal obligations of the Firm. Please note that if this Data cannot be processed, ANL Avocat could be unable to deliver its services, which would lead to the non-conclusion or termination of the contract. ANL Avocat draws the attention of its Clients to this point on a case-by-case basis, as far as possible.
3.Who are the people affected by this processing?

the customers of the Law Firm ANL Avocat, who are natural persons,

the officers, employees, agents or consultants of our clients,

the managers, employees, agents or consultants of our customers' suppliers or service providers,

people who are not clients but are interested in the Firm's services: training, newsletters, publications, etc.

anyone who contacts ANL Avocat to request information relating to the Firm's activities

any potential candidate wishing to apply for a job with ANL Avocat

any person related to our clients or candidates (e.g. service provider, supplier, employee, etc.) of which the data is transmitted to us by your care, after obtaining their prior express agreement or who contact us directly. It is your responsibility to ensure that these persons understood correctly any information regarding the usage that will be made with their data, by disclosing notably this data protection notice and shall be able to provide documentary evidences of the prior consent.

4.What are the categories of recipients?
Only people who need to know and/or access to your data, as part of their missions, can have access to your data and process it.

5. Why does ANL Avocat collect or use your personal data?
The Law Firm processes the data entrusted to:

Carry out the missions as described in your service contract concluded with ANL Avocat

Investigate and prevent fraudulent activities, related to money laundering or terrorism, in accordance with the law

The data collected from potential clients is processed in order to answer questions about the activity of ANL Avocat

The data communicated by the participants or the people wishing to participate in events organized by ANL Avocat are processed in order to ensure the recording of the registration and its smooth running.

The data provided by candidates applying to ANL Avocat is used to process their application as part of the recruitment process.

The data transmitted by the suppliers or partners of the Firm are processed as part of the execution of the contract concluded (payment, various correspondence, etc.) ANL Avocat never collects data if it is not strictly necessary for the execution of its mission.
Regarding commercial communications, ANL Avocat undertakes to obtain your consent before sending them.
Without your prior consent, ANL Avocat will not contact you for marketing purposes. You can withdraw your consent at any time: contact@anl-avocat.com or by clicking on the “unsubscribe” link included in the communications.
ANL Avocat does not perform profiling or any kind of automated processing of your data.

6. What is the basis on which the processing is carried out?
The processing of your data is based on:

The need to perform the contract concluded between ANL Avocat and you or if this is necessary in the context of a pre-contractual relationship

The need for the Law Firm to comply with its legal obligations

Your consent obtained in accordance with the applicable provisions of the Law

The need to ensure the defense of the Law Firm.

7.How are your data processed?
ANL Avocat uses technical, organizational and administrative security measures to protect the personal data entrusted to it, for any loss, misuse, unauthorized access or disclosure, alteration or destruction.

ANL Avocat uses technical security measures such as: a firewall, antivirus software, encryption of confidential data

ANL Avocat's subcontractors have made contractual commitments to protect and restrict access to personal data

ANL Avocat makes its employees aware of the importance of respecting the protection of personal data and privacy.
In general, ANL Avocat ensures that your data is stored securely and that it is accurate and up to date.

8.How long are your data kept?
The data is kept until the latest of these dates:
For customer data:

End of the client relationship, for whatever reason, in accordance with the terms of your contract signed with ANL Avocat,

End of the retention period required by law or by any competent authority regulating the activity of ANL Avocat. In general, a copy of your data is kept for a period of 10 years after the end of the commercial relationship for accounting and tax reasons, calculated in accordance with the applicable legal requirements.

End of the period during which a dispute or investigation may take place in relation to the data processed or, if applicable, until the end of the dispute or investigation.
For data entrusted by persons interested in the services:

Expiry of a period of three (3) years after the date of sending a commercial proposal (unless the person becomes a client before the expiry of the said period)

Expiry of a period of three (3) years after the realization of an event organized by ANL Avocat
Concerning the data of candidates applying for a job offer or sending an unsolicited application:

Six (6) months after the end of the recruitment procedure (except in the case of hiring before the expiry of this period)
For data transmitted by Law Firm suppliers or partners:

End of the commercial relationship, for whatever reason, in accordance with the terms of the agreement signed with ANL Avocat,

End of the retention period required by law or by any competent authority regulating the activity of ANL Avocat. In general, we keep a copy of the data for a period of 10 years after the end of the commercial relationship for accounting and tax reasons, calculated in accordance with the applicable legal requirements.

End of the period during which a dispute or investigation may take place in relation to the data processed or, if applicable, until the end of the dispute or investigation.

9.Your rights
Under the conditions provided for by law, you may benefit from certain rights relating to the processing of your personal data and more specifically, you have:

A right of access to your data, including the right to obtain a copy,

A right to rectify your personal data, including the right to request their updating or completion,

A right to erasure and a right to be forgotten in accordance with the provisions provided for by law,

The right to lodge a complaint with a supervisory authority, (see section 11 below)

The right to withdraw your consent at any time, without affecting the legitimacy of the processing carried out on the basis of your consent, prior to this withdrawal (see section 6 above).

10. Transfer outside the European Union
Your Personal Data is mainly processed in the European Union.
On exceptional basis, ANL Avocat subcontractors, service providers or suppliers may transfer your personal data outside the territory of the European Union:

either in a State offering an adequate level of protection according to the European Commission

or by taking measures (for example: contractual measures) to ensure under the Law, the same level of protection as if the third party were located in the European Union.

11.Right to lodge a complaint
For any questions, you can contact ANL Avocat (see contact information in section 1).
If you are not satisfied with the way in which your personal data is processed or following a request relating to the exercise of your rights as set out in section 9, you can file a complaint. with a supervisory authority or lodge a judicial appeal.
In the Grand Duchy of Luxembourg, the supervisory authority is the CNPD: National Data Protection Commission.
